Quick, my wife is an insurance agent and licensed through the state of Florida so she'll be able to answer those questions for you. If I got to court and lose, I still will have to pay the ticket... more then likely a reduced price. Also pay court fees and yes I can still take the driving class so the points get removed from my license. I've taken this class in the past (years ago) and my license is clear. This is the first time though that I will go to court for a ticket. I got a few local suggestions today. I'm going to call the court house next week sometime to schedule a court date. Will have my wife has a witness and also provide proof.
Thank you Ron, that's what everyone has been telling me. My driving record has been clean for about 6 yrs now. So I'm hoping the judge looks into that as well and takes it into consideration.
Don't fight it unless you don;t mind losing. Chances are, the judge will side with the officer even if you bring your wife as a witness. I have had personal experience fighting tickets three different times and I lost all three times. One time my wife was the witness.
Yea, but on this one it sounds like maybe there is very little downside. Time and maybe court costs. If he wins he's golden. If he loses he can still go to school and have the points removed.
Depends on what type of ticket your fighting. If its a speeding ticket, wreckless driving, aggressive driving, street racing, running a stop sign, etc. you will lose. The ticket, which is sitting right infront of me right now, lacks any sort of evidence and its all assumptions by the officer. I'd rather fight it, knowing that I'm not guilty then just eat it... pay it... take the driving class to have the points removed. If I lose, then I'll pay the ticket and take the driving class to remove the points. Its just the principle that I didn't do anything wrong so its worth fighting IMO. 99% of the people here and on other forums said to fight it. People at my job and my wife's job said to fight it. Even family members said to fight it. I'm going to fight it.
^ Good...I think you should win. This has got to be the worst ticket I've ever heard about. It makes almost no sense at all. Hopefully the officer doesn't show, and makes it easier to win. Although it would be rather interesting to here how he justifies the ticket.
go to court and fight it trust me if he dont show up and u explained to the judge it will get drop i had one in pasco that i won and i was speeding
Definitely... sounds like he can't even prove it was you. A "red blur" could have been any car, truck, etc.
Alright everyone just got back home from court. My wife went with me as a witness and the Officer did show up! I gave a "turn of events" as far as what all took place minutes from getting pulled over to the time of being pulled over. I then also gave "my statement". Judge asked me a couple/few questions then asked my wife a couple questions. CASE WAS DISMISSED!
YOU ALWAYS FIGHT A TICKET. the only time you can say f*ck it is if its chp that pulled you over. thats great news to hear.
