bad news and good news

    well first the bad news as some of you know i own an electrical and ac business. Ok let me give you the run down the reason the company ran into trouble is that after completing a big commercial job the general contractor basically stole the money that was suppossed to be paid to me. Now i was not hired by the general contractor i was actually hired by the business owner. For some strange reason the general contractor got the finance dept to pay him for my work. this was not known to myself or the owner until we asked where our payment was. now just to let you know i am out $150,000 dollars. now this situation is going to court. The owner of the business and myself have an agreement in writing signed and notorized that if nthing gets accomplished in court he will pay me an amount that we have agreed upon.
    So i had to pay employees and venders out of my pocket and basically had to let my employees go (actually i found jobs for them with other companies)
    now i have since closed my business due to the fact that the economy sucks and i dont have the employees i need to do the jobs i was doing.
    Now im on the unemployment list but wait the good news
    I got a job today working for McDonalds yes thats right i will be the best buger maker i can be lol just kidding actually i am working for McDonalds
    but i am the new maitanence supervisor for the area woohoo
    cool part is i eat free while i am working hehehe!!!
    so i would like to say thank you god for this job and now i can resume my moddin of the 300 yea!!!!:usflag:

    Good luck! That really sucks!! i am a carpenter in NY and this is the first time I have been out of work. Slow as shit out there! Glad you got something!!

    That fing BITES. I am glad you and the business owner have made an agreement, but I am failing to see "Why" he did not pay you after the fact. It seems to me that his accountant made a mistake and is still liable for your payment. This business should then take the GC to court.


    I am very happy that you have found something that is able to pay your bills and allow you to live on. You have good Karma on your side.

    Best of luck with the court action and having some kind of job is better than no job, usually, so great news about that. :)

    wow Tim .. sorry to hear this man .. having talked to you before I know your a good guy and its tough because of all the dishonest people out there. people are being very narrow minded right now and are only looking out from themselves, not fully understanding the negative effect they have on people like you, the people that work for you and your families ... while I applaud you for finding a new job to pay the bills, dont let this disturb your goals and the business you have established. also I wish you the best of luck with the new position ..

    I work in construction - metal fabrication and I deal with various owners and general contractors in the PA, DC, VA, MD, NJ and NY areas .. I know you have to be very careful now with the people you do work with .. more trust is required now more then ever. I hope when you get back at it that you realize THERE ARE good people out there and dont let this have a negative effect on how you view people and other businesses ..

    I have dealt with the legal aspect before in this business .. I had a customer receive 1.2 million for a contract I was hired on to fabricate .. I put out over 150k in raw material, 80k in labor, 15k in engineering and 90k in additional services that I have not received $1 for. I have a suit against the company that has left me angry, upset and overall disgusted and it took me a while to get over it and I'm still not ... the legal process is a long one and it will cause the pain and anguish of this project to continue on for many years .. this project happened for me in late 06 and finally our court date is approaching in dec 09. the only advice I can offer you is to avoid the legal aspect and try to settle at any reasonable cost .. you will not get your 150k but it will save you the heartache and the legal fees along the way. I hope this option is available to you ..

    hey guys and gals yes this sucks but i have an agreement with the owner that if the court case is not settled in one year of the date the job was completed he will pay me x amount a month untill the debt is paid off i am not blaming the owner for what happened but i cant figure out how the accounting dept screwed up like that they time i collected from them before they paid me directly for the first phase of the project but how they say shit happens. actually i found out the general contractor is in jail at the moment for other related charges and our first court date is in november. so once again i thank god for looking out for us.

    Suck to hear about the leagal aspect, but at least you have been able to line up work...especially in this economy. Good luck getting your money back.

    Brother that sucks and I know exactly where you're coming from. At the end of last year we finished up a project at a marine base for a company who's owners I USED to consider friends. I've known these guys long before they ever opened their doors and since they started the company have done many jobs with them. But they have ALWAYS been slow payers. BTW, the amount they owe me is right where your at.

    I paid for the entire project, all suppliers paid in full, all subs paid in full, you know the routine. Well it was 4 months after completion and now I'm starting to get pissed. Well they flat out tell me they're broke and used that money for other loses they incurred on another project and they aren't paying. So get this, me being the nice guy I am and not wanting to kill their bonding ability never filled the required stop payment notices as I SHOULD HAVE DONE.

    So basically, I'm screwed, I have no legal recourse.

    But I don't understand something. If your contract was with the owner. And he paid his GC. Why is it you're going after the GC, you don't have any right to do so, that's the owners responsiblility.

    Best of luck bud, I know how hard it is to fold a business. I closed my doors on my first business after a unscrupulous GC burnt me and several sub's long ago. I lost everything except my house, filed BK, the whole rolla bolla. I then went back to work for someone for a year and a half and then started this business with nothing. No credit, no money, only the tools I had.

    That was 17 years ago.

    And it's everything I can do to keep the doors open right now. Everyone is gone except two guys and even though they have been working their 40's for the last three months, there is no guarantee the doors will be open next week.

    Cam the owner is the one filing the suit i am there because of the contract between us
    i guess you would say i am the witness in the case. i will get most of my money the owner has paid me some of what was owed and the amount stated earlier is what amount left owed to me give or take a few. The owner of the business and i have agreed on a payment plan which is based on his gross income of the business
    but the fact that i had to foot the bill for materials and labor and everything else basically killed me i could have forced him to sell and pay me but that would not have done either of us any good. as you know i cant get into to many details about the case but in the end it will work out hopefully. i am just hopeing that i can get what is owed pretty soon in full. i did find out this morning that not only is the GC injail but his assets have been siezed and accounts frozen. also the feds have joined in the investigation
